Terms of Service

Version 1.0. These terms apply from the date this page is published.

These terms are between you and Pohlmann Ventures UG (haftungsbeschränkt), registered with the Commercial Register of the Local Court of Charlottenburg (Berlin) under HRB 222538 B (“we”, “us”). They govern this website and the services we operate: Compaction accounts, device activation, entitlements, Engine distribution, allowance and usage records, and the waitlist.

1. What these terms do and do not cover

Software licences are separate from these terms, and these terms do not narrow them.

  • The Compaction CLI and open-source core are licensed under the Apache License 2.0. Nothing here limits, conditions, or adds obligations to the rights that licence grants you. If you only use the CLI, you need no account and these terms apply to you only if you use this website.
  • The Compaction Hybrid Engine is distributed separately and governed by the Compaction Engine License Agreement.
  • These terms govern the website and the services listed above.

Where these terms and a licence appear to conflict, the licence governs the software and these terms govern the service.

2. Using the website

The website is informational and documentary. You may read it, quote it with attribution, and link to it. You may not attempt to break it, probe it for vulnerabilities without permission, scrape it in a way that degrades it for others, or use it to distribute malware or unlawful content.

3. Accounts

Some features require a Compaction account. You create one by signing in with GitHub or with an email address. You must be able to enter into a binding contract to hold an account, and you are responsible for what happens under it and for keeping your sign-in method secure. Do not create an account with someone else’s identity.

You can stop using an account at any time. Write to hello@compaction.dev to have it deleted. We may suspend or close an account that breaks these terms or the Engine agreement, or where we are required to.

4. Device activation and entitlements

To use an account from the CLI you activate a device. Activation registers that device with your account and issues a signed entitlement, which the CLI checks locally. Your tier determines how many devices you may register and what allowance the entitlement carries.

Entitlements are time-limited and are renewed while your account remains in good standing. We may revoke an entitlement if these terms or the Engine agreement are broken.

5. Community, allowance, and paid plans

Community is free. It includes output shaping, the Hybrid Engine, and a monthly optimized-input allowance. The allowance applies to optimized input only. When what remains cannot cover a request, input optimization pauses for that request: output shaping keeps running, nothing is debited, and the request still reaches your provider and still succeeds. We do not buy more capacity on your behalf.

We set the allowance and may change it for future periods. A free service can be changed or withdrawn, and we will give reasonable notice where we can.

There is no paid plan today. Pro and Team are waitlist only. Joining the waitlist gives us your email address and the tier you are interested in. It is not a purchase, not a reservation, and not a commitment by either of us. We will contact you about availability and you can ask us to remove you at any time.

6. Acceptable use of the services

You may not:

  1. interfere with entitlement, allowance, metering, or signature checks, or misreport usage;
  2. share, resell, or pool an entitlement beyond what your tier allows;
  3. use the services to process content you have no right to process;
  4. attempt to gain access to another account, or to any part of our systems you were not given access to.

7. Your content

Your prompts, your code, and your completions stay yours. We do not take any right in them, and the services described here do not require you to send them to us. What our services do handle is described in our Privacy Policy.

Traffic to your AI provider still goes to that provider under your own agreement with them, using your own credentials. We are not a party to it.

8. Availability

We do not promise the website or the services will be available without interruption. We may change, suspend, or discontinue any part of them. Where a change would stop your existing installation from working, we will try to give notice, but for a free service we cannot guarantee it.

9. Disclaimer

The website and the services are provided as they are, without warranty of any kind, whether express, implied, or statutory, to the fullest extent the law allows. We do not promise any particular reduction in tokens, cost, or latency. If you are a consumer, your statutory rights are unaffected.

10. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, data, or goodwill.

Our total liability arising from the website and the services is limited to what you paid us in the twelve months before the claim arose. There is no paid plan today, so for a Community account that amount is nil.

Nothing here limits liability that cannot be limited by law, including liability for intent, gross negligence, injury to life or body, or liability under applicable product liability law.

11. Changes to these terms

We may issue a new version of these terms. The current version is always on this page, and the version number at the top changes when the text does. If a change materially affects you and you hold an account, we will tell you by email or in the product before it takes effect. Continuing to use the services after that means you accept the new version.

12. General

If any part of these terms is unenforceable, the rest stays in effect. You may not assign them; we may assign them as part of a merger, acquisition, or sale of assets. You must comply with applicable export control and sanctions law.
